1. Acceptance of Terms
By accessing or using SyncUp, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service. SyncUp is a synchronized video watching platform that allows users to watch content together in real-time.
"SyncUp" here means the website at syncup.tv and the SyncUp apps for iOS and Android. These terms cover all of them.
2. Description of Service
SyncUp provides a platform for users to create and join watch rooms where video playback is synchronized across all participants. The service allows users to share and watch video content together in real-time.
SyncUp runs in a web browser and as a mobile app. The app is distributed through the Apple App Store and Google Play, and your use of it is also subject to the rules of whichever store you got it from. Apple and Google distribute the app, they do not operate SyncUp, so this agreement is between you and us and not with either of them.
3. User Accounts
You must be at least 13 years old to use SyncUp. If you are in a country where the age of digital consent is higher than 13, you need permission from a parent or legal guardian until you reach that age.
To access certain features of SyncUp, you must create an account. You agree to:
- Provide accurate and complete information when creating your account
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
4. Acceptable Use
You agree not to use SyncUp to:
- Share or stream content that you do not have the right to distribute
- Violate any applicable laws or regulations
- Infringe upon the intellectual property rights of others
- Harass, abuse, or harm other users
- Share, solicit, or produce any content that sexualises or exploits a minor, or use SyncUp to groom, endanger, or sexually exploit anyone under 18
- Distribute malware or engage in any malicious activities
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the service for any illegal or unauthorized purpose
5. Content Responsibility
Users are solely responsible for the content they share through SyncUp. We do not host video content directly; users share links to external video sources. You represent and warrant that you have all necessary rights to share any content through our platform.
Abusive behavior and objectionable content are not tolerated here. On the website and in the app you can block another user, which cuts off chat, direct messages, friend requests and presence between the two of you in both directions, and you can report a user or a specific message. Reports go to a queue that we read.
Child sexual abuse and exploitation is handled separately and more strictly than anything else on this list. Our Child Safety Standards set out what is prohibited, how to report it, and how we respond.
We reserve the right to remove any content or terminate accounts that violate these terms or applicable laws.
6. Intellectual Property
The SyncUp service, including its design, features, and functionality, is owned by SyncUp and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our service without our express written permission.
7. Premium Features and Payments
SyncUp may offer premium features or subscription plans. All payments are processed securely through Polar, who acts as the Merchant of Record for all transactions. By purchasing a subscription or one-time plan, you agree to the applicable pricing and payment terms. Please see our Refund Policy for details on cancellations and refunds.
There are no purchases inside the mobile app. Subscriptions and passes are bought on the website, and the app only shows you which plan your account is on. On Android the app links out to the website to upgrade or manage a plan. On iOS whether that link is shown depends on the App Store storefront your Apple Account is registered in, because Apple's rules on linking out differ by region. Where the link is not shown, you can open syncup.tv in a browser and do the same thing there.
8. Disclaimer of Warranties
SyncUp is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, secure, or error-free. Your use of the service is at your own risk.
9. Limitation of Liability
To the maximum extent permitted by law, SyncUp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service.
10. Termination
We reserve the right to suspend or terminate your access to SyncUp at any time, with or without cause, and with or without notice. Upon termination, your right to use the service will immediately cease.
11. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the European Union and the applicable member state where the service is operated, without regard to conflict of law principles.
12. Changes to Terms
We may update these Terms of Service from time to time. We will notify you of any significant changes by posting the new terms on this page and updating the "Last updated" date. Your continued use of SyncUp after such changes constitutes your acceptance of the new terms.
